Review and Comment - Draft Nerve Conduction Studies and Electromyography Policy

On June 1, 2023, two Medicare Administrative Contractors (MACs) released identical proposed local coverage determinations (LCDs) for nerve conduction studies and electromyography. The MACs, Novitas Solutions, and First Coast Service Options, cover providers in several states. As of the time this article was written, we have not seen policy drafts from other MACs.

Novitas Solutions and First Coast Service Options are accepting comments on the draft policy, due July 15. The MACs are also hosting open meetings where these policies will be discussed. First Coast Service Options is hosting a meeting on June 15 – register here. Novitas Solutions is hosting a meeting on June 16 – register here. Please note these are multi-hour meetings during which the nerve conduction studies and electromyography policy will be one of many agenda items.

Legislation Introduced to Alleviate Impact of Conversion Factor Cut for 2021

Last month, two bills were introduced in the House proposing solutions to the estimated 10.6% Physician Fee Schedule conversion factor cut expected to go into effect January 1, 2021.  The bills offer some relief to the cut, but do not reflect a comprehensive or long-term solution.  AAPM&R has therefore chosen to remain neutral regarding these bills. 

Your Academy continues to advocate for a permanent solution to the conversion factor cut while maintaining the important payment increases to office and outpatient evaluation and management services.
