CMS Contractor Announces Release of New Comparative Billing Report on Subsequent Nursing Facility E&M Services

Citing improper payment rates for CPT Codes 99308 (4.5%), 99309 (7.9%), and 99310 (25%), the contractor for the Centers for Medicare and Medicaid Services that issues Comparative Billing Reports (CBRs) announced a new CBR related to subsequent nursing facility evaluation and management (E/M) services.

As noted by the contractor, “A CBR is an educational tool that reflects your billing patterns as compared to your peers’ patterns for the same services in your state and/or nationwide. The CBR is intended to enhance accurate billing practices and support providers’ internal compliance activities.”

Legislation Introduced to Alleviate Impact of Conversion Factor Cut for 2021

Last month, two bills were introduced in the House proposing solutions to the estimated 10.6% Physician Fee Schedule conversion factor cut expected to go into effect January 1, 2021.  The bills offer some relief to the cut, but do not reflect a comprehensive or long-term solution.  AAPM&R has therefore chosen to remain neutral regarding these bills. 

Your Academy continues to advocate for a permanent solution to the conversion factor cut while maintaining the important payment increases to office and outpatient evaluation and management services.
